Facility Usage Agreement

Scope of Application

Article 1.
1 Any and all rental agreements entered into by and between the owner or manager of this facility (hereinafter "Host") and the user of this facility (hereinafter "Guest") and other agreements related thereto shall be governed by this regulation, and any matters not stipulated herein shall be governed by laws and generally established customs.
2 Notwithstanding the preceding paragraph, in cases where the Host accepts any special provisions to the extent not contrary to laws or customs, the special provisions shall prevail.

Application for Facility Usage Agreement

Article 2
1. A person who desires to apply for usage of the facility shall be required to provide the Host with the following:

(1) Name of guest(s);
(2) Date/period of usage;
(3) Facility usage charge;
(4) Cleaning charge;
(5) Any other matters the Host requires.

2. A person who desires to apply for usage of the facility shall be required to provide the Host with personal identification such as a passport (in the case of Guests without Japanese nationality and who do not reside in Japan) or a passport or driver's license (in the case of Japanese citizens and Guests without Japanese nationality who reside in Japan) for the purpose of identity verification.

3. In cases where a Guest applies for an extension of the period of usage beyond the period of usage set forth in Item (2) of the preceding paragraph during his/her period of usage, the Host shall treat the application as a new one at the time of the offer.

Concluding the Facility Usage Agreement

Article 3.
1 A facility usage agreement shall come into effect when the Host approves the application set forth in the preceding Article.

2 In cases where a Guest fails to pay the facility usage charge, etc., the facility usage agreement shall become invalid.

3 In cases where the Host approves an extension of the period of usage as set forth in paragraph 3 of the preceding Article, the original period of usage and the additional period of usage shall be considered together as one agreement.

Rejection to Concluding the Facility Usage Agreement

Article 4.
1 The Host may reject an application to conclude a facility usage agreement in cases falling under any of the following events:
(1 When the application does not conform to this regulation;
(2) When the Host cannot afford to accept the application due to lack of a vacant room;
(3) When one who desires to use the facility is considered to be likely to commit any activities against laws, public order or morals in regard to facility usage;
(4) When one who desires to use the facility is considered to fall under any of the following items:
a. An organized crime group designated in Item 2 of Article 2 of the Act on the Prevention of Unjust Acts by Organized Crime Group Member (Act No. 77 of 1991) (hereinafter "Organized Crime Group"), an Organized Crime Group member set forth in Item 6 of Article 2 of the aforementioned Act (hereinafter "Organized Crime Group Member"), an associate member of an Organized Crime Group, or a person involved in Organized Crime Groups or other anti-social forces;
b. A juridical person or other body whose business activities are controlled by an Organized Crime Group or an Organized Crime Group Member;
c. A juridical person any of whose executive officers is an Organized Crime Group Member;
(5) When one who desires to use the facility is a notable nuisance to the neighborhood or other guests;
(6) When one who desires to use the facility is considered to have clearly contracted an infectious disease;
(7) When one who desires to use the facility is considered to have committed a violent act in regard to facility usage or to have demanded a burden beyond the reasonable range of the facility;
(8) When usage of the facility is impossible due to unavoidable reasons, including but not limited to natural disaster and equipment malfunction.

Termination Right of Guests

Article 5.
1. A Guest may terminate a facility usage agreement by notifying the Host. However, a guest may not terminate facility usage agreements for periods of stay at the facility of less than seven (7) days except in cases of unavoidable circumstances, including sudden illness, etc.
2. In cases where a Guest terminates a facility usage agreement in whole or in part due to reasons attributable to the Guest, he/she shall pay a cancellation charge set forth separately.
3. In cases where a Guest fails to arrive on the date of usage by the scheduled time of arrival, the Host may consider the facility usage agreement to have been terminated by the Guest, and shall handle it as such.

Termination Right of Host

Article 6.
1. The Host may terminate a facility usage agreement in cases falling under any of the following events:
(1) (1) When a Guest is considered likely to commit any activities against laws, public order or morals, or when the Guest is considered to have committed said activities in regard to facility usage;
(2) When a Guest falls under any of the following items:
a. An Organized Crime Group, an Organized Crime Group Member, an associate member of an Organized Crime Group, or a person involved in an Organized Crime Group or other anti-social forces;
b. A juridical or other body whose business activities are controlled by an Organized Crime Group or an Organized Crime Group Member;
c. A juridical person any of whose executive officers is an Organized Crime Group Member;
(3) When a Guest has committed a notable nuisance to the neighborhood or other guests;
(4) When a Guest is considered to have clearly contracted an infectious disease;
(5) When a Guest has committed a violent act in regard to facility usage or has demanded a burden beyond the reasonable range of the facility;
(6) When the Host is unable to allow usage of the facility due to reasons beyond its control, including by not limited to natural disaster.
(7) When a Guest fails to comply with usage regulations established by the Host regarding prohibited actions, including but not limited to smoking in bed in the room, tampering with firefighting equipment, etc.

2. In cases where the Host terminates a facility usage agreement in accordance with the provisions of the preceding paragraph, services related to facility usage or other services that have not been provided by the Host shall not be charged. However, in cases requiring a cancellation charge, termination shall not prevent the right to demand the cancellation charge.

Guest Room Usage Time

Article 7.
1. The time period during which a Guest may use a guest room belonging to the Host shall be as informed separately by the Host.

Compliance with Usage Regulations

Article 8.
1 Guests shall comply with usage regulations established by the Host and posted within the facility.

Payment of Charges

Article 9.
1. Details regarding the facility usage charge to be paid by the Guest shall be as set forth in Appendix 1. 2. The Guest shall pay the facility usage charge, etc. even if the Guest voluntarily forgoes using the facility after a guest room becomes available by provision of the Host.

Host Liability

Article 10.
1. The Host shall compensate the Guest for any damages occurred due to the execution or failure of execution of the facility usage agreement and other agreements related thereto. However, this shall not apply if said damage is caused by reasons not attributable to the Host.

2. The Host shall communicate with Guests using English and Japanese. However, additional languages may become available without notification.

3. The Host shall provide the following services necessary for lodging. However, the services concerned may be provided by workers contracted by the Host.
a. Provision of a clean room to the lodger at the beginning of use and all services necessary to provide a clean room;
b. Foreign language explanations on how to make use of the facility;
c. Response in case of emergency, including fire, etc.

Treatment in case of inability to provide guest room for which an agreement has been made

Article 11.
1. In cases where the Host is unable to provide a guest room for which an agreement has been made, the Host shall, with the Guest's consent, arrange for another usable facility with the same conditions as far as possible.

2. Notwithstanding the provisions of the preceding paragraph, in cases where the Host is unable to arrange for another facility, the Host shall pay compensation equivalent to the facility usage charge to the Guest. However, this shall not apply if the said unavailability is due to reasons not attributable to the Host.

Custody of Guest's Baggage and Belongings

Article 12.
1. In cases where a Guest has left behind baggage or belongings after checking out, the Host shall contact the owner if said owner is known to the Host, and the Host shall confirm the method of handling. However, in cases where the owner is unreachable or unknown, the items shall be held in custody for a period of seven (7) days including the date of discovery, and after that period, the items shall be delivered to the nearest police station. The Guest shall bear responsibility for costs required for any method of handling

2. The Host shall bear responsibility to hold the Guest's baggage and belongings provided for in the preceding paragraph with the same care and caution as the Host's own assets.

Guest Liability

Article 13.
1. In cases where the Host suffers any damage caused intentionally or due to negligence on the part of the Guest, the Guest concerned shall compensate the Host for the damage.

2. The Guest shall comply with the following items:
a. Usage instructions for equipment installed in the facility;
b. Waste disposal instructions indicated by the Host;
c. Avoid causing trouble for surrounding people through loud noises, etc.
d. Points of contact and initial response measures indicated by the Host for use in emergencies such as fire, etc. (Including usage instructions for fire prevention and disaster prevention equipment.)
e. Other usage regulations established by the Host regarding prohibited actions.
